Hong Kong’s New Land Title Registration Regime – Better late than never?

This lecture will focus on the following aspects of the new title registration regime under the Land Titles Ordinance (Cap. 585) (“LTO”):

• Key differences between the new title registration regime under the LTO and the existing deed registration system under the Land Registration Ordinance (Cap. 128) (“LRO”).

• Rationale behind such fundamental changes.

• Government’s proposed “Two-Stage Conversion Mechanism” and the “New Land First” approach targeted for implementation in the first half of 2027.

• Key legal features of the LTO, in particular the important concept of “indefeasible title” and conclusiveness of title registration, including how bona fide purchasers for valuable consideration and in possession of the property will enjoy such indefeasible title, even where prior transactions involve third-party fraud.

• Operation of the Land Titles Indemnity Fund as a compensation mechanism and other proposed ancillary measures, such as tiered land searches, electronic applications, and identity verification by specified persons under the Titles and Land (Miscellaneous Amendments) Ordinance 2025.

• Potential implications of the new title registration regime on various industry stakeholders, including surveyors, investors, lenders, and conveyancing lawyers.
