In this lecture, the speaker discusses: (1) The training and education of insolvency practitioners; (2) The proposed changes to the Winding up provisions of the Companies Ordinance; (3) The contracting out of liquidation work and its effect on corporate governance in Hong Kong; (4) The licensing of insolvency practitioners, including the HKICPA’s SQ and SD; (5) The remuneration of insolvency practitioners and the problems with the current process in Hong Kong; and (6) The introduction of the UNCITRAL model law.

About the Speaker

Stephen Briscoe

Stephen Briscoe has worked full time on insolvency and corporate recovery assignments since 1973. He worked for 11 years for the Official Receiver in the United Kingdom before moving into private practice and has considerable experience in investigations, liquidations, and trading receiverships, particularly in the manufacturing, service and leisure industries. He has practiced in Hong Kong since 1997 where he has acted as liquidator or receiver of several hundred insolvent companies in a variety of industry sectors including construction, property, shipping, manufacturing, import and export and various service industries. Many corporate recovery assignments in Hong Kong have a PRC element and he has had acted for foreign investors on numerous occasions in creating value from distressed investments in Sino Foreign Equity Joint Ventures or Wholly Foreign Owned Enterprises in the PRC. He, Professor Charles D. Booth and the late Professor Smart, jointly wrote the first edition of the Hong Kong Corporate Insolvency Manual. He is one of the course directors of the Hong Kong Insolvency Diploma course organised by the Hong Kong Institute of Certified Public Accountants. He is also the convener of the technical committee of the Restructuring and Insolvency Faculty of the HKICPA. He is the managing director of Briscoe Wong Ferrier which specialises in corporate recovery and restructuring; liquidation and receivership; and forensic accounting and litigation support in Hong Kong and PRC. He also publishes a website at www.hkinsolvency.com which deals with insolvency and corporate recovery issues in Hong Kong and the PRC.
