An important but less often talked about infrastructure behind Hong Kong as an international capital market is its insolvency regime, which is efficient and effective in protecting the interests of creditors and companies alike. It is also in tune with and regularly invoked alongside other common law insolvency jurisdictions as well as the Mainland insolvency regime in myriad cross-border cases. This lecture will provide an overview of this interesting and developing regime.

About the Speaker
The Hon Madam Justice Linda Chan was appointed as the Judge of the Court of First Instance of the High Court of the Hong Kong Special Administrative Region in December 2019. She was appointed as the Judge in charge of the Companies and Bankruptcy List in August 2021. She was in private practice from 1998 and was appointed as Senior Counsel in 2011. Whilst in private practice, she mainly practiced in commercial, companies and insolvency matters. These included commercial disputes, applications relating to Companies Ordinance, schemes of arrangement, shareholder disputes, winding up and bankruptcy matters. She advised and represented numerous corporate and individual clients from various jurisdictions, as well as liquidators, in large-scale corporate insolvency matters, including those with international dimensions. She regularly advised the Official Receiver on matters which had significant financial ramifications or involved constitutional issues.
